Welcome to Your Way Home ("YWH", "we", "us", or "our"), these Terms of Use ("Terms") govern your access to and use of our Your Way Home platform and the Your Way Home web platform and related services. The terms “application”, “platform”, “service”, “site”, and “YWH” refer to Your Way Home AB and its affiliated websites and services (collectively, “Your Way Home”).
These Terms of Use described the legally binding terms and conditions that oversee your use of the Site. BY LOGGING INTO THE SITE, YOU ARE BEING COMPLIANT THAT THESE TERMS and you represent that you have the authority and capacity to enter these Terms. YOU SHOULD BE AT LEAST 18 YEARS OF AGE TO ACCESS THE SITE. IF YOU DISAGREE WITH ALL OF THE PROVISION OF THESE TERMS, DO NOT LOG INTO AND/OR USE THE SITE. The User accepts the Terms and Conditions of the Service and consents to the collection and processing of personal data in accordance with the Your Way Home Privacy Policy. You also agree that the Your Way Home Privacy Policy forms an integral part of the Terms and Conditions of the service.
1. Access to the Site
Subject to these Terms. YWH grants you a non-transferable, non-exclusive, revocable, limited license to access the Site solely for personal, non-commercial use.
Certain Restrictions. The rights approved to you in these Terms are subject to the following restrictions: (a) you shall not sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Site; (b) you shall not change, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Site; (c) you shall not access the Site in order to build a similar or competitive website; and (d) except as expressly stated herein, no part of the Site may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means unless otherwise indicated, any future release, update, or other addition to functionality of the Site shall be subject to these Terms. All copyright and other proprietary notices on the Site must be retained on all copies thereof.
By accepting this agreement, you acknowledge that the Your Way Home platform constitutes a platform where its content is contributed by both users and the public or private entities that compose it. The content of the reports or comments on the platform are the sole responsibility of those who issue them.
Your Way Home reserves the right to change, suspend, or cease the Site with or without notice to you. You approved that Your Way Home will not be held liable to you or any third-party for any change, interruption, or termination of the Site or any part.
Your use and continued use of the platform constitutes your acceptance of all Terms and Conditions as well as any risks inherent in the application and the service. You provide the Application with accurate, truthful and complete information (including, but not limited to, gender, date of birth and email address) and to keep the information accurate and up-to-date.
Your Way Home does not knowingly collect information from Users under the age of 13. Your Way Home reserves the right, in its sole discretion, to deny access to the Application to any User, at any time and for any reason, including, without limitation, for violation of this Agreement.
No Support or Maintenance. You agree that Your Way Home will have no obligation to provide you with any support in connection with the Site. Excluding any User Content that you may provide, you are aware that all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Site and its content are owned by Your Way Home.
Third-Party Links & Ads. The Site may contain links to third-party websites and services, and/or display advertisements for third parties. Such Third-Party Links & Ads are not under the control of Your Way Home, and Your Way Home is not responsible for any Third-Party Links & Ads. Your Way Home provides access to these Third-Party Links & Ads only as a convenience to you, and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Links & Ads. You use all Third-Party Links & Ads at your own risk and should apply a suitable level of caution and discretion in doing so. When you click on any of the Third-Party Links & Ads, the applicable third party’s terms and policies apply, including the third party’s privacy and data gathering practices.
Other Users. Each user of the Site is solely responsible for any and all User Content on its own. You may submit content to the Site, including, but not limited to, feedback, photos, audio, video ("User Content"). You retain all rights to and are solely responsible for User Content that you upload or submit to our Site.
You represent and warrant that you own or have the necessary licenses, rights, consents and permissions to use and authorize us to use your User Content as necessary to provide our Site and related services.
By uploading or submitting User Content to our Site, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, display, reproduce, modify, and distribute your User Content in connection with our Site and related services.
We reserve the right, in our sole discretion, to remove any User Content that violates these Terms or is otherwise objectionable.
As in any public communication space, Your Way Home has no control or assumes or can assume responsibility for the reports made by our users on the platform. It is our users' responsibility for the security and confidentiality of their password as well as limiting access to their devices. It is forbidden to share your password or account with third parties.
Your Way Home is a platform fostering citizen collaboration, where users and other participating entities openly share reports and information. By utilizing our service, you grant Your Way Home the authority to utilize, transmit, and store the information you share through reports, subject to the limitations outlined in our Privacy Policy.
Under the terms and conditions of this agreement, Your Way Home commits to providing users access to the report submission service facilitated by Your Way Home, its users, or third-party service and content providers. However, Your Way Home is not obligated to take action regarding reports generated by its users.
To utilize Your Way Home 's reporting service, users must create an account through which they can access and utilize the services offered by Your Way Home, its users, or third-party service and content providers.
In using the platform, you warrant (i) the truthfulness, accuracy, currency and completeness of all information provided through the application; (ii) if you register an account, you will protect your account data, supervise and accept full responsibility for any use made by third parties; (iii) you are over the age of 13, the age limit for registering an account and posting contributions on the application; (iv) that you are legally authorized to enter into this Agreement and to use the application in accordance with all Terms and Conditions included herein.
Users understand and agree that Your Way Home may provide some or all of the services outlined in this agreement through either Your Way Home itself or its users, subject to the same obligations stipulated in these terms and conditions and our Privacy Policy.
Your Way Home prohibits the use of its services for illegal or immoral purposes. It is especially prohibited:
The site is provided on an "as-is" and "as available" basis, and Your Way Home expressly disclaim all warranties and conditions of any kind, whether express, implied, or statutory, including all warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. We make not guarantee that the site will meet your requirements, will be available on an uninterrupted, timely, secure, or error-free basis, or will be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe. In no event shall we be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our website or these Terms, whether based on contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, in no event shall Your Way Home be liable to you or any third-party for any lost profits, lost data, or any indirect, consequential, exemplary, incidental, special or punitive damages arising from or relating to these terms or your use of, or incapability to use the site even if YWH has been advised of the possibility of such damages. Access to and use of the site is at your own discretion and risk, and you will be solely responsible for any damage to your device or computer system, or loss of data resulting therefrom.
The above limitation of liability does not apply to any mandatory statutory liability, in particular the liability under the corresponding Consumer Codes. Furthermore, such limitation of liability does not apply if Your Way Home has made specific warranties.
Term and Termination.
Subject to this Section, these Terms will remain in full force and effect while you use the Site. We may suspend or terminate your rights to use the Site at any time for any reason at our sole discretion, including for any use of the Site in violation of these Terms. Upon termination of your rights under these Terms, your Account and right to access and use the Site will terminate immediately. You understand that any termination of your Account may involve deletion of your User Content associated with your Account from our live databases. Your Way Home will not have any liability whatsoever to you for any termination of your rights under these Terms.
As part of the Site Agreement, we grant you the right to use the Site for your personal, non-commercial use. You may use the Site only as permitted by these Terms. You may not and will not permit any other party to: (i) modify, translate, or create derivative works of Your Way Home; (ii) access the Services for the purpose of extracting data, whether manually or through automated means, and/or apply the Site for any commercial purpose. All of our intellectual property rights related to the Services (such as copyrights, trademarks, and all content contained in the Services) remain the exclusive property of Your Way Home and its licensors and will not be transferred to you in any way. If you do not comply with the above terms of use, we will terminate the Site Agreement and suspend any further access to the Site.
Your Way Home respects the intellectual property of others and asks that users of our Site do the same. The Website and its contents, including but not limited to text, graphics, images, logos, and video, are the property of YWH and are protected by Swedish and international copyright laws. If you believe that one of our users has unlawfully infringed the copyright in a work through the use of our site and wish to remove the allegedly infringing material, you must contact us with a written notice.
If any provision of these Terms is held by any court or competent authority to be invalid, illegal or unenforceable, that provision shall be deleted from these Terms and the remainder of the Terms shall remain valid and enforceable to the fullest extent permitted by law.
Indemnification. You agree to indemnify and hold harmless Your Way Home, its affiliates, officers, directors, employees, agents and licensors from and against any claims, actions, suits or proceedings, and any losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or your violation of these Terms.
